In order to implement the relevant requirements of the Opinions of the General Office of the State Council on Promoting the Sustainable and Healthy Development of the Construction Industry (No. 19 [2017] of the State Council), clarify work responsibilities, and promote the reform and development of the construction industry as a whole, the following division of labor plan is formulated:
1. deepen the reform of streamlining administration and delegating powers in the construction industry
(I) optimize qualification management. Further simplify the construction enterprise qualification category and grade setting, reduce unnecessary qualification. Select some areas to carry out pilot projects, and for enterprises with good credit, relevant professional and technical capabilities, and able to provide full guarantees, relax the restrictions on the scope of contracting business within their qualification categories, and at the same time, accelerate the improvement of the credit system, project guarantees, and personal practice qualifications. Supporting systems, strengthen supervision during and after the event. Strengthen the management of individual practice qualifications, clarify the rights, obligations and responsibilities of registered practitioners, and increase the accountability of practice. Orderly development of individual practice firms, and promote the establishment of an individual practice insurance system. Vigorously promote "Internet" government services, implement "one-stop" online approval, and further improve the efficiency of administrative approval in the construction field. (II) improve the bidding system. We will speed up the revision of the provisions on the scope and scale of bidding for construction projects, narrow and strictly define the scope of construction projects that must be tendered, relax the relevant scale standards, and prevent the implementation of "one size fits all" bidding for construction projects ". In the private investment of housing construction projects, explore the construction unit to decide the way of contracting. Incorporate construction projects that must be tendered in accordance with the law into a unified public resource trading platform, follow the principles of fairness, justice, openness and integrity, and standardize bidding behavior. Further simplify the bidding procedures, realize the whole process of bidding and bidding transactions as soon as possible, and implement online remote bid evaluation. For government procurement construction projects in which suppliers are determined through competitive negotiations or single-source methods in accordance with the law, construction permits shall be issued if they meet the corresponding conditions. 2. Perfecting the Organization Mode of Engineering Construction
(III) speed up the implementation of general contracting. In principle, assembly buildings should adopt the general contracting model. Government investment projects should improve the construction management model and take the lead in the implementation of general contracting. Accelerate the improvement of the project general contracting related to bidding, construction permits, completion acceptance and other system provisions. In accordance with the principle of overall responsibility of the general contractor, implement the responsibilities of the general contractor in terms of project quality and safety, progress control, and cost management. In addition to the projects that are included in the scope of the general contracting of the project in the form of provisional valuation and must be tendered according to law, the general contracting unit of the project may directly contract out other professional businesses covered in the general contracting contract. (IV) cultivate the whole process of engineering consulting. Encourage investment consulting, survey, design, supervision, bidding agency, cost and other enterprises to develop whole-process engineering consulting by means of joint operation, merger and reorganization, and cultivate a number of whole-process engineering consulting enterprises with international standards. Develop technical standards and contract models for full-process engineering consulting services. Government investment projects should take the lead in the implementation of the whole process of engineering consulting, and encourage non-government investment projects to entrust the whole process of engineering consulting services. In civil construction projects, give full play to the leading role of architects and encourage the provision of full-process engineering consulting services. 3. strengthen engineering quality and safety management
(V) strictly implement the project quality responsibility. Fully implement the main project quality responsibilities of all parties, especially to strengthen the primary responsibility of the construction unit and the main responsibility of the survey, design, and construction unit. Strictly implement the lifelong responsibility system for project quality, set up permanent signs in obvious parts of the building, and publicize the main body of quality responsibility and the main responsible person. For those who violate relevant regulations and cause engineering quality accidents, administrative penalties such as suspension of business for rectification, lowering of qualification levels, and revocation of qualification certificates shall be imposed on the responsible unit in accordance with the law, and publicity shall be made through the national enterprise credit information publicity system, and registered practitioners shall be given suspension of practice, revocation of qualification certificates, Penalties such as not being allowed to enter the industry for a certain period of time. If a project quality accident causes losses, the economic compensation liability shall be investigated according to law, and the legal liability of the relevant units and personnel shall be investigated if the circumstances are serious. Construction enterprises involved in real estate development should operate in accordance with the law and improve the quality of housing. (VI) strengthen production safety management. Fully implement the responsibility of safety production, strengthen the safety protection of the construction site, especially to strengthen the management of sub-projects with greater risks, such as deep foundation pits, high formwork, lifting machinery, and the risk assessment or demonstration of major projects in adverse geological areas. Promote the in-depth integration of information technology and production safety, accelerate the construction of construction safety supervision information systems, and strengthen production safety management through information technology. Establish and improve a full-coverage, multi-level, and regular safety production training system to improve the safety quality of employees and the intrinsic safety level of all parties. (VII) comprehensively improve the level of supervision. We will improve the laws, regulations and management system of project quality and safety, and improve the quality and safety guarantee system of enterprise responsibility, government supervision and social supervision. Strengthen the government's supervision of project quality, clarify the scope of supervision, implement supervision responsibilities, increase random inspections, and focus on strengthening the supervision and inspection of the foundation, main structure and other parts of the project involving public safety, as well as the completion acceptance. Strengthen the construction of the project quality supervision team, and the funds required by the supervision agency to perform its functions shall be fully guaranteed by the financial budget at the same level. The government may purchase services and entrust qualified social forces to carry out project quality supervision and inspection. Promote the standardized management of project quality and safety, and urge all parties to improve the quality and safety control mechanism. 4. Optimize Construction Market Environment
(8) Establishing a unified and open market. Break the barriers to regional market access, cancel the unreasonable access conditions set by various regions and industries for construction enterprises in addition to laws, administrative regulations or the provisions of the State Council; it is strictly forbidden to set up approval and filing matters without authorization or in disguise, so as to provide a fair market environment for construction enterprises. Improve the national construction market supervision public service platform, and accelerate the realization of data sharing and exchange with the national credit information sharing platform and the national enterprise credit information publicity system. Establish a blacklist system for the main body of the construction market, fully disclose the good credit records and bad credit records of enterprises and individuals in accordance with laws and regulations, and accept social supervision. (IX) strengthen contract performance management. Guide the contracting enterprise to provide performance guarantee to the construction unit in the form of bank guarantee or guarantee company guarantee. For government-invested projects that adopt conventional general technical standards, while the principle of winning the bid at the lowest price, effectively play the role of performance guarantee, prevent malicious low-cost winning bids, and ensure that the project investment does not exceed the budget. Strictly investigate and deal with subcontracting and illegal subcontracting. Improve the project quantity list pricing system and the project cost information release mechanism, form a unified project cost pricing rules, and reasonably determine and effectively control the project cost. (X) standardize the settlement of the project price. Audit institutions shall, in accordance with the law, strengthen the audit and supervision of public works construction projects mainly invested by the government, and the construction unit shall not use the incomplete audit as a reason for delaying the settlement of the project or defaulting on the project payment. For projects that have not been completed and settled, the relevant departments shall not handle the registration of property rights. Units that have been in arrears for a long time shall not approve the commencement of new projects. Strictly implement the project advance payment system, and pay the advance payment to the contractor in full and in time according to the contract. Through the project payment guarantee and other economic and legal means to restrain the performance of the construction unit, to prevent the default of the project payment. 5. improve the quality of employees
(11) Accelerate the training of construction talents. Actively cultivate a team of architects with both international vision and national self-confidence. Accelerate the training of senior management personnel in the construction industry who are familiar with international rules. Vigorously promote school-enterprise cooperation to train construction professionals. Strengthen the education and training of site management personnel and construction workers. By 2020, the number of construction workers with intermediate skills or above in the construction industry will reach 3 million, and by 2025 it will reach 10 million. (12) Reform the construction employment system. Promote the transformation of labor service enterprises in the construction industry, and vigorously develop professional enterprises focusing on operations, such as carpentry, electrician, masonry, and steel production. With professional enterprises as the main carrier of construction workers, we will gradually realize the corporatization and professional management of construction workers. Encourage existing professional enterprises to further specialize, enhance their competitiveness, and promote the formation of a group of professional construction enterprises that focus on operations. Promote the transformation of migrant workers in the construction industry to skilled workers, and focus on stabilizing and expanding the employment and entrepreneurship of migrant workers in the construction industry. Establish a national construction worker management service information platform, carry out real-name management of construction workers, record the identity information, training, vocational skills, employment records and other information of construction workers, and gradually achieve full coverage. (13) to protect the legitimate rights and interests of workers. Fully implement the labor contract system, increase supervision, and urge construction units to sign labor contracts with construction workers recruited in accordance with the law, and basically achieve full coverage of labor contracts by 2020. We will improve the wage payment security system, implement the responsibility of enterprise wage payment in accordance with the principle of who employs and who is responsible for the overall responsibility of the general contractor, and pay workers' wages in full on a monthly basis in accordance with the law. Enterprises with wage arrears are included in the "blacklist", disciplinary measures such as restricting market access are taken, and the qualification level is lowered if the circumstances are serious. Establish and improve social insurance payment methods that are compatible with the construction industry, and vigorously promote construction units to participate in work-related injury insurance. The construction unit shall fulfill its social responsibility, continuously improve the working environment of construction workers, enhance the level of occupational health, and promote the stable employment of construction workers. 6. Promote the Modernization of Construction Industry
(14) Promote smart and fabricated buildings. Adhere to standardized design, factory production, assembly construction, integrated decoration, information management, and intelligent applications, promote innovation in construction methods, vigorously develop prefabricated concrete and steel structure buildings, and advocate the development of modern wood structure buildings where conditions permit, Continuously increase the proportion of prefabricated buildings in new buildings. Strive to use about 10 years, so that the proportion of prefabricated buildings in the new building area reached 30%. Promote the popularization of intelligent applications in new buildings and existing building renovation, improve the operation and maintenance mechanism of intelligent systems, and realize building comfort, safety, energy saving and high efficiency. (15) Improve the level of architectural design. We will improve the bidding system adapted to the characteristics of architectural design, and promote the bidding of design teams and design schemes. Promote fair competition between domestic and foreign architectural design enterprises and cultivate an internationally competitive architectural design team. Actively support scientific research in the construction industry and greatly increase the contribution rate of technological innovation to industrial development. (17) Improve engineering construction standards. Actively cultivate group standards, encourage industry associations, industry alliances and other entities with corresponding capabilities to jointly formulate standards that meet the needs of the market and innovation, establish a standard supply system that combines mandatory standards with group standards, and enhance the effective supply of standards. Timely review of standards, speed up the revision of standards and improve the timeliness of standards. Strengthen the information communication between scientific and technological research and development and standard formulation, establish a national engineering construction standards expert committee, provide technical support for engineering construction standardization, and improve the quality and level of standards. (18) Strengthen the convergence of Chinese and foreign standards. Actively carry out comparative research on Chinese and foreign standards, adapt to the internationally accepted standard content structure, element indicators and related terms, and narrow the technical gap between Chinese standards and foreign advanced standards. We will strengthen the translation, publicity and promotion of the foreign language version of China's standard, and give priority to the promotion and application of foreign investment, technology export and construction aid projects under the guidance of the "Belt and Road Initiative" strategy. Actively participate in international standards certification, exchanges and other activities, to carry out bilateral cooperation in engineering and technical standards. Construction enterprises should strengthen the research on international standards, actively adapt to international standards, strengthen the management of the quality and performance of foreign contracted projects, and play an active role in foreign aid housing and other livelihood projects. Encourage large enterprises to drive small and medium-sized enterprises and enterprises in coastal and border areas to cooperate to go out to sea, actively and orderly open up the international market, and avoid vicious competition. Give full play to the role of various financial instruments and focus on supporting major strategic projects in the construction field in foreign economic cooperation. Learn from the internationally accepted project financing model, in accordance with the principles of risk control and commercial sustainability, increase financial support for the "going out" of the construction industry. All regions and departments should attach great importance to deepening the reform of the construction industry, improve the working mechanism, clarify the division of tasks, timely study and solve major problems in the reform and development of the construction industry, and improve relevant policies. If the same work involves multiple departments, the lead department should strengthen coordination, strengthen inter-departmental collaboration, and promote the implementation of the work.
